Real Estate - Landlord/Tenant Law

Landlord/Tenant Law

Finding yourself involved in a landlord and tenant dispute can be a challenging and often frustrating experience.  Whether you are a tenant who has fallen behind on rent or a landlord with a non-paying renter, you need the assistance of an experienced firm to help you find the resolutions you need. Our knowledge of landlord and tenant law allows us to address even the most complicated types of disputes. We can help you with the following:

  • Residential and commercial unlawful detainer (eviction)
  • Preparation of notices (including: 3-day notice to pay rent or quit, 30-day notice to vacate property and many others.)
  • Review, drafting and negotiation of rental agreements and leases
  • Damage caused by tenants
  • Mold Claims
  • Criminal activity (ie. grow houses)
  • Security deposits
  • Rights and Responsibilities during the tenancy
  • Breach of the warranty of habitability, and other legal violations
  • Premises Liability
  • Discrimination and Retaliation
  • Nuisances - including noise complaints, unsafe conditions, failure to maintain a clean and sanitary premises

Poorly prepared evictions proceedings will guarantee problems for the landlord if the eviction action was not properly executed from the start.  The 3/30/60 day notices must meet all technical requirements, service of the notice must meet all legal standards and rent amounts must be calculated with precision. Although eviction trials are usually quick and deal with the issue of possession, they are nevertheless potentially complicated trials. Evidence needs to be properly presented, authenticated and argued. We regularly prepare and carry out eviction trials and understand the skill set necessary to properly execute a trial and deliver a judgment for possession. We can help you avoid common problems and mistakes, and find the best cost-effective strategy. Many times these legal issues are quickly resolved with a simple phone call or letter from our office to the offending party that outlines the legal argument that exists, and are taken on a sliding scale depending on the person's ability to pay or amount in dispute. Other times, more complex litigation will be required. So call our offices today to discuss your legal needs.
