An expungement of a criminal record is a short legal process that changes and updates the disposition of you case to reflect that a dismissal has been granted under PC 1203.4. The purpose of an expungement is to clear a history of criminal charges that might adversely affect your chances of employment or education. In many circumstances, once a case has been expunged, the prior conviction or plea does not need to be divulged. Am I qualified to have my misdemeanor expunged?
In most cases, if probation was granted, you may be eligible for relief if the conditions of probation have been fulfilled, OR you have been discharged from probation, AND:
1. You are not now serving a sentence for any offense, AND
2. You are not one probation for any offense, AND
3. You are not currently charged with committing any offense.
